That warning is the one that Circular 1/2022 of the Comisión Nacional del Mercado de Valores — the CNMV, Spain's securities regulator — used to require in crypto-asset advertising aimed at Spain. It has been repealed since 28 December 2024 by Circular 1/2024, whose single article puts nothing in its place: it withdraws the rule because the EU's MiCA regulation now governs crypto-asset advertising and a member state can no longer legislate on the matter.

So no Spanish rule obliges us to show that box today, and we show it anyway, first on the page. MiCA regulates those who issue crypto-assets and those who provide services with them; it does not turn a purchase into a covered product, nor does it stop the money from being lost in full. As long as that remains true, the warning stays.

What that means in practice

• Nobody has assessed your situation. A real investment recommendation takes account of your income, your assets, your time horizon and your tolerance for risk. Here we know none of that, so we cannot — and must not — tell you what to do with your money.
• The data may be out of date or wrong. Prices come from an external API and are refreshed every fifteen minutes. There can be delays, gaps and errors at source. Before you trade, check the price on the exchange where you are going to do it.
• Scenarios are not forecasts. When we say how much a coin would have to rise to get back to its all-time high, we are dividing two numbers that already exist. We are not saying that it is going to happen.
• The past does not anticipate the future. The fact that an asset has multiplied a thousandfold since its all-time low says absolutely nothing about what it will do tomorrow.

The risks of crypto-assets

Without any claim to be exhaustive, and because it is worth having them in front of you:

• Volatility. Falls of 30% or more in a few days are normal in this market, not exceptional.
• No compensation scheme. Crypto-assets are not covered by the Fondo de Garantía de Depósitos, Spain's deposit guarantee scheme, or by the Fondo de Garantía de Inversiones, its investor compensation scheme. If the exchange goes under, or your account is frozen, there is nobody to give you your money back.
• Liquidity. You may not find a buyer at the price on the screen, especially in small coins and in a falling market.
• Technology and custody risk. Protocol failures, bugs in smart contracts, attacks on exchanges and lost keys. A lost private key is lost money, with no recourse.
• Regulatory risk. The legal framework changes, and it can change abruptly, with a direct effect on the price and on your ability to trade.
• Tax. Crypto-asset transactions are taxable in Spain. Consult a tax adviser.
